Fertility Options for LGBT Couples: Legal Aspects
The Center for Human Reproduction’s Dr. David H. Barad explains the legal rights of international LGBT fertility patients, in the US and in their home countries.
CHR helps couples from all over the world, all kinds of couples including lesbian and gay couples. We’ve had gay couples come down to us from Canada and from other parts of the world, certainly from other parts of the country. The issue with being outside of New York or outside of the United States will be that the couple has to deal with their own legal systems. If a gay couple, or anybody, uses a carrier from a different country from that which they live and she delivers from outside the country, there could be legal issues with bringing the baby home, so we encourage all of our patients who are in these arrangements, to seek legal counsel within their own country so they understand what they need to do in order to make this work. CHR has a fair experience in dealing with gay and lesbian couples and helping them build their families. We’ve had, some folks have come back for second and third pregnancy. In these situations it’s very rewarding to see these families grow and to see and reaffirm that anybody can have a loving family, and we’re happy to be able to help in that regard.
